By accessing or using the ATM Algo platform ("Platform") at atmindicator.com and algo.atmindicator.com, you ("User", "Subscriber", "You") agree to be legally bound by these Terms & Conditions in full. These Terms form a binding legal contract between you and ATM Algo. If you do not agree, you must immediately stop using the Platform.

Nothing on the ATM Algo platform — including algorithm outputs, notifications, dashboards, performance data, P&L reports, risk-reward ratios, communications, or any content — constitutes investment advice, financial planning, portfolio management, tax advice, or stock recommendations of any kind.
All trades are executed based on automated strategy logic selected by you, the user. Users must independently evaluate whether any strategy is suitable for their financial situation, risk tolerance, and investment objectives. ATM Algo bears no responsibility for your financial decisions.
ATM Algo makes absolutely no guarantee of any specific profit, income, or positive return. Risk-reward ratios (1:1, 1:2, 1:3) describe strategy design structure — NOT guaranteed outcomes. Past performance does not guarantee future results. You may lose part or all of your invested capital. We are not responsible for any trading losses under any circumstances.
The Access Token provided by you grants ATM Algo the sole and limited technical ability to place buy and sell orders through your broker's API. This token does NOT grant ATM Algo the ability to withdraw funds, transfer securities, modify account settings, view personal banking information, or perform any action beyond automated order placement under your subscribed algorithm. The Access Token remains your property at all times and can be revoked instantly from your broker platform.
Token Expiry Mid-Trade: If your Access Token expires or is revoked while a position is open, ATM Algo will be unable to place exit or stop-loss orders. You are solely responsible for monitoring token validity and managing any open positions manually in such circumstances. ATM Algo bears no liability for losses from token expiry.
Platform Availability: While ATM Algo strives to maintain uninterrupted service, we do not guarantee that the platform will be available at all times. Scheduled maintenance, server outages, third-party service disruptions, exchange-level issues, or unforeseen technical problems may temporarily affect platform availability. ATM Algo shall not be liable for any trading losses arising from temporary platform downtime, system interruptions, or service unavailability.
Third-Party Services: The ATM Algo platform integrates with third-party services including stockbrokers, payment gateways, cloud infrastructure providers, and analytics services. ATM Algo has no control over these third-party services and shall not be liable for any service disruption, delay, failure, data breach, or security incident occurring within those third-party systems. Each third-party provider's own terms, privacy policies, and service agreements apply independently.

ATM Algo's maximum total liability for any claim shall be strictly limited to the subscription amount paid in the immediately preceding 1-month period. We shall not be liable for any direct, indirect, incidental, consequential, or punitive damages — regardless of how such loss arises.

You agree to indemnify, defend, and hold harmless ATM Algo, its founders, directors, employees, affiliates, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:
This indemnification obligation will survive the termination of your account and these Terms.
All algorithms, source code, strategy logic, UI designs, brand name, logo, and content are the exclusive intellectual property of ATM Algo / ATM Indicator. You are granted a limited, non-exclusive, non-transferable, revocable licence for personal use only. You may not reverse-engineer, copy, resell, sub-licence, or share access to any part of the platform.
ATM Algo reserves the right to suspend or permanently terminate your account without prior notice if you: share account credentials; attempt to reverse-engineer algorithms; provide false information; initiate fraudulent chargebacks; violate Indian law; or engage in conduct harmful to the platform or other users.
Upon termination, your broker connection will be immediately severed. No refund will be issued for the remaining subscription period in cases of termination for policy violations. Open positions will no longer be managed by the platform — manage them manually through your broker.
ATM Algo may update, optimise, or modify algorithm logic to improve performance or adapt to changing market conditions. Users will be notified of significant changes at least 48 hours in advance via email or platform notification where operationally feasible. Continued use after notification constitutes acceptance. If you do not accept a material change, you may request account closure — no refund will be issued for the remaining period.
In the event of any dispute, controversy, or claim arising from or relating to the use of the ATM Algo platform, these Terms & Conditions, or any breach thereof, both parties agree to first attempt resolution through good-faith negotiations within 30 days of written notice of the dispute.
If the dispute cannot be resolved through negotiation within 30 days, the matter shall be referred to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended).
The arbitration shall be conducted by a sole arbitrator appointed by ATM Algo. The seat and venue of arbitration shall be New Delhi, India. The arbitration proceedings shall be conducted in English. The decision of the arbitrator shall be final and binding on both parties and enforceable in any court of competent jurisdiction.
Each party shall bear their own costs of arbitration unless the arbitrator determines otherwise. This arbitration clause shall survive the termination of these Terms.
These Terms are governed by the laws of India. Subject to the arbitration clause above, any disputes not resolved by arbitration shall be subject to the exclusive jurisdiction of competent courts in New Delhi, India.
ATM Algo reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use constitutes acceptance. Contact: contact@atmindicator.com
